A good day for CCFC although relief is certainly the right word and not the best for Langston/Hammam as their case brought against The Mighty Mighty Bluebirds was dismissed.
Technically, the case now moves ahead for full trial for the technical detail to be played out in full
but it's more likely both parties will now talk to try an hammer a new agreement. It would be astonishing if Hammam/Langston given a strong summary against them with Lord Justice Briggs declaring that CCFC have a strong chance of success with their defence does indeed press ahead with action.
The main points are:
- Summary Judgement Dismissed
- The judge didn't give Langston leave to appeal the summary judgement, it was described as an unsuitable case to present in that arena.
- Langston can still apply for leave directly to appeal by 10 June
- Judge advised for everyone to get round the table and wished them success in doing that.
- Both parties asked for a 2 month deferment for the full trial, hopefully taking the time to make sense with each other.
- Langston have to pay CCFC's costs within 28 days
- Judge also said it was a clear case, no technicalities necessary
It is an action that seems both unecessary and damaging, CCFC have certainly been affected by it, Langston/Hammam appear to have lost more credibility and respect and, indeed, CCFC's case strongly inferred Langston = Hammam.
What's next? We'll have to wait and see but hopefully the waves will be smoother moving ahead although, one thing's for sure, with Hammam directly (or indirectly) behind the action, you just never know.
